These Terms and Conditions (“Terms”) govern the services provided by Bacharach Construction (“Company,” “we,” “us,” or “our”), a general contractor based in Portland, Oregon. By engaging our services, accessing our website, or entering into any agreement with us, you (“Client,” “you,” or “your”) agree to be bound by these Terms. If you do not agree, please do not use our services.

1. Services

• We provide general contracting services, including but not limited to residential and commercial construction, remodeling, renovations, and related project management in the Portland, Oregon area.
• All services will be performed in accordance with applicable local, state, and federal laws, including Oregon building codes.
• Project details, scope, timelines, and costs will be outlined in a separate written contract or proposal (“Agreement”) signed by both parties. These Terms supplement any such Agreement.

2. Proposals and Agreements

• Proposals are estimates based on information provided at the time and are valid for 30 days unless otherwise stated.
• Changes to the scope of work must be agreed upon in writing via a change order, which may affect timelines and costs.
• We reserve the right to subcontract portions of the work to qualified third parties, but we remain responsible for the overall project.

3. Payment Terms

• Payments and terms are specified in the Agreement, typically including a deposit upon signing, progress payments, and a final payment upon substantial completion.
• All payments must be made in U.S. dollars via check, bank transfer, or other agreed methods.
• You are responsible for any applicable taxes, permits, or fees unless otherwise stated.

4. Timelines and Delays

• Project timelines are estimates and may be affected by factors beyond our control, such as weather, material shortages, or unforeseen site conditions.
• We will make reasonable efforts to complete work on schedule but are not liable for delays caused by force majeure events (e.g., natural disasters, strikes, or government actions).
• Any delays will be communicated promptly, and extensions may be granted in writing.

5. Warranties and Liabilities

• We warrant that all work will be performed in a professional manner using quality materials for a period of one year from completion, unless a longer warranty is specified in the Agreement.
• This warranty does not cover normal wear and tear, misuse, or modifications by third parties.
• Our liability is limited to the cost of the services provided. We are not liable for indirect, consequential, or punitive damages.
• You agree to indemnify us against claims arising from your negligence or provision of inaccurate information.

6. Cancellations and Terminations

• You may cancel the Agreement before work begins, but deposits may be non-refundable to cover administrative costs.
• If you terminate after work starts, you will be responsible for costs incurred up to that point plus a reasonable termination fee.
• We may terminate for non-payment, safety concerns, or other material breaches, with written notice.

7. Insurance

• We maintain general liability insurance as required by Oregon law. Proof is available upon request.
• You are responsible for maintaining adequate property insurance on the project site.

8. Dispute Resolution

• Any disputes arising from these Terms or our services will first be addressed through good-faith negotiation.
• If unresolved, disputes will be settled through mediation or arbitration in Portland, Oregon, under the rules of the American Arbitration Association.
• If litigation is necessary, it will be in the courts of Multnomah County, Oregon.

9. Governing Law

• These Terms are governed by the laws of the State of Oregon, without regard to conflict of laws principles.

10. Privacy

• We collect and use personal information as necessary for providing services, in compliance with applicable privacy laws.

11. Changes to Terms
